PocketCoder Pro Commercial Software and Service Terms

These Commercial Software and Service Terms (the “Terms”) are an agreement between Qtpi Bonding LLC (“PocketCoder,” “we,” “us,” or “our”) and the person or legal entity using PocketCoder Pro (“you” or “your”).

By downloading, purchasing, subscribing to, or using PocketCoder Pro, the Aeroform/PN functionality, or related PocketCoder services (collectively, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

1. What PocketCoder provides

PocketCoder Pro is commercial software that helps you provision and operate your own infrastructure. The Service may provide:

These features are provided to make self-management easier. They are not a promise that PocketCoder will administer, host, monitor, or guarantee the availability of your infrastructure.

You always retain the option to manage your deployment yourself using the available free and open-source PocketCoder software and documented interfaces. Nothing in these Terms prevents you from using, modifying, self-hosting, or managing the applicable free and open-source components in accordance with their own licenses.

2. Your infrastructure and third-party providers

You own or control the infrastructure and third-party accounts used with the Service, including your cloud-provider account, VPS, operating system, PocketBase instance, application data, domains, credentials, and integrations.

PocketCoder does not own, host, or control those accounts or resources. Your relationship with a cloud provider, including Linode/Akamai, is governed by that provider’s terms. You are responsible for provider charges, quotas, regions, networking, domains, credentials, access permissions, backups, and compliance with applicable provider rules.

When you authorize provisioning or another infrastructure action, you instruct PocketCoder to make the corresponding request or change on infrastructure you control. You are responsible for confirming that you have authority to do so.

3. Best-effort operational features

PocketCoder may provide upgrade, restart, health-check, rollback, recovery, diagnostic, and related operational features as part of the Service. These features are included for convenience and are provided on a best-efforts basis.

They may be unavailable, delayed, interrupted, incompatible with your environment, require manual action, fail to complete, or cause downtime. We do not guarantee successful provisioning, upgrades, restarts, rollbacks, recoveries, uninterrupted operation, or preservation of data.

You are responsible for maintaining independent and current backups and for verifying your environment after any PocketCoder action. A rollback or recovery feature is not a substitute for a backup.

4. Credentials and security

You are responsible for providing accurate credentials, granting only the permissions necessary for the requested action, protecting authentication materials, and promptly revoking credentials that are lost, exposed, or no longer needed.

PocketCoder may store or process credentials locally or through the components required to perform an authorized action. Do not provide credentials that you are not authorized to use. You are responsible for reviewing the permissions requested by the Service and for securing your device and infrastructure.

5. AI, commands, and user decisions

PocketCoder may display generated explanations, commands, plans, or suggested actions. These outputs may be incomplete, inaccurate, or unsuitable for your environment. You are responsible for reviewing and approving actions before they are executed and for the consequences of commands, prompts, repositories, skills, MCP servers, models, and integrations that you configure or authorize.

PocketCoder is not a substitute for professional infrastructure, security, legal, or operational advice.

6. License and use of the commercial Service

Subject to these Terms and your payment of applicable fees, PocketCoder grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the commercial PocketCoder Pro software and Aeroform/PN functionality for your personal or internal business purposes during the applicable subscription or license period.

You may not sell, sublicense, rent, lease, redistribute, reverse engineer, or provide unauthorized access to the proprietary commercial components, except where applicable law or an applicable open-source license expressly permits it.

The free and open-source components included with or used by PocketCoder remain available under their respective licenses. Those licenses control where they conflict with these Terms.

7. Subscriptions, trials, and payments

Paid features, trials, renewal terms, and pricing are presented at purchase. Subscriptions purchased through Apple, Google, or another billing provider are also subject to that provider’s payment, renewal, cancellation, and refund rules.

Unless the purchase screen says otherwise, subscriptions renew automatically until cancelled through the applicable billing provider. Cancelling a subscription stops future renewal but does not necessarily refund amounts already charged.

Refund policy: All purchases are billed through Apple’s App Store or Google Play, and refund handling differs by platform. For Apple purchases, Apple decides all refund requests — we cannot issue or override a refund ourselves; request one through your Apple account purchase history. For Google Play purchases, we may be able to issue a refund directly on request; contact us at marketing@qtpi.app or request one through your Google Play purchase history.

Cloud-provider charges are separate from PocketCoder charges and are your responsibility.

8. Acceptable use

You may not use PocketCoder to violate law or third-party rights, deploy malware, conduct unauthorized access, attack or disrupt systems, abuse cloud provider resources, evade security controls, or operate infrastructure for fraudulent or harmful purposes.

You must comply with the laws, licenses, and terms applicable to your content, code, credentials, infrastructure, and third-party services.

We may stop providing a particular commercial feature, release, integration, or support for a version when reasonably necessary for security, legal, technical, or business reasons. This does not give us control over or permit us to suspend your cloud-provider account, VPS, PocketBase instance, or data.

9. Updates and release channels

PocketCoder may publish stable, beta, and nightly releases. Stable releases are intended for ordinary use. Beta releases are previews, and nightly releases are development builds intended primarily for testing.

Updates may change functionality, require downtime, require user action, or stop supporting older environments. You decide whether and when to apply an update unless a separate written agreement says otherwise.

10. Intellectual property

PocketCoder and its licensors retain all rights in the proprietary PocketCoder Pro, Aeroform/PN commercial components, branding, documentation, and related materials. These Terms grant usage rights only and do not transfer ownership.

You retain your rights in your infrastructure, code, prompts, content, credentials, and data. You grant PocketCoder only the permissions necessary to provide the Service and perform actions you authorize.

11. Privacy

Our handling of personal information is described in the PocketCoder Privacy Policy: pocketcoder.org/privacy.

You are responsible for ensuring that the data, credentials, code, and content you process through your own infrastructure are collected and used lawfully.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” POCKETCODER DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, SECURITY, AND ERROR-FREE OR DATA-PRESERVING OPERATION.

POCKETCODER DOES NOT WARRANT THAT PROVISIONING, CONFIGURATION, DEPLOYMENT, UPDATES, RESTARTS, HEALTH CHECKS, ROLLBACKS, RECOVERIES, AI OUTPUTS, OR THIRD-PARTY INTEGRATIONS WILL BE SUCCESSFUL, AVAILABLE, ACCURATE, SECURE, OR SUITABLE FOR YOUR ENVIRONMENT.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POCKETCODER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, ACCESS, DATA, OR USE, ARISING FROM OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POCKETCODER’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO POCKETCODER FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

These limitations do not apply to liability that cannot lawfully be limited.

14. Indemnity

To the extent permitted by law, you agree to defend and hold harmless PocketCoder and its officers, employees, and contractors from claims, losses, liabilities, and expenses arising from your unlawful use of the Service, your infrastructure, your content or credentials, your violation of these Terms, or your violation of a third party’s rights.

15. Termination and continued self-management

You may stop using the commercial Service at any time. Termination of your commercial license or subscription does not terminate, suspend, delete, or modify your cloud-provider account, VPS, PocketBase instance, or data.

After termination, you may continue to use any applicable free and open-source components under their licenses. Commercial-only functionality and support may no longer be available.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version and change the effective date. If a change materially affects your rights, we will provide notice where required by law. Your continued use of the Service after the effective date means you accept the updated Terms.
